Any monies received by Stay Sedona and affiliates for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest's invitees.
Guest rents, for vacation purposes only, the furnished real property and improvements described in the listing.
APPROVED GUEST & USE
The premises are for the sole use as a personal vacation residence by Approved Guest. Reserving guest is responsible for any guest that uses the property during the term of this agreement. We strongly suggest if you are the reserving guest you are the last person to inspect and leave the property. No unlawful activity or any other activity which constitutes a nuisance is permitted on the premises. Approved guest takes full responsibility for all lost, stolen or broken items, this includes damage to the physical structure of the property as well.
DOWN PAYMENT/ SECURITY DEPOSIT
Final payment will be required prior to checking-in to your vacation rental.
A valid credit card, to be kept on file, will be required upon reservation. Guest herby grants consent to charge the credit card for any damages, missing items, excessive cleaning, fines, the cost of any reservations which has to be forfeited and, if necessary, cost incurred to remove guest and/or guest of approved guest from the property.
As a condition to the rental of all vacation properties, Stay Sedona and affiliates reserves the right to charge the guest's credit card for any and all uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Stay Sedona and affiliates is hereby granted the right to charge the guest's credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.
If there are concerns or issues with your rental property, please contact us immediately. No refunds or considerations are given unless we are notified of problems during your stay.
All reservations are subject to Management and property owner approval. Online rates are subject to change without notice.
In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact us at (928) 282-0904 and send us a text, for a faster response. If it is after office hours, we will make every effort to return your call as soon as possible. Office hours are 8AM - 6PM daily.
Check in is at 4PM. An early arrival may be arranged, pending other reservations and the housekeeping schedule. Please contact us prior to your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time.
Check out is at 10AM. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure may be arranged, pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged a fee for each hour beyond 10 AM you are still on property, at a minimum of one hour. If the home has not been vacated by NOON, a fee equal to the average rental rate of one day may be assessed.
Power/weather related cancellation: Stay Sedona and affiliates does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages, forest fires or pandemics.
Cancellation Policy on Rentals:
30+ Day rentals: A $150 cancellation fee will be charged for cancelled reservations. Advance payments less the cancellation fee is refunded according to the following schedule:
45 days prior to arrival 50% refund, less the cancellation Fee and service fees charged by the OTA's.
Less than 30 days prior to the date of arrival: 0% refund
Short-term rentals (29 days or less): A $150 cancellation fee will be charged for canceled reservations. Advance payments less the cancellation fee is refunded according to the following schedule:
30 days prior to the date of arrival: 50% refund, less the cancellation Fee and service fees charged by the OTA's.
Less than 30 days prior to the date of arrival: 0% refund
Cancellation or early departure does not warrant any refund of rent.
There is a non-refundable pet fee of $150, if pets are allowed at the property you booked.
Travel insurance may be available.
NUMBER OF GUESTS
Change in number of guests/conduct of guests: guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the vacation rental at any time could result in extra charges for each additional guest, in addition to any and all damage, disturbance, and cleaning charges. Each additional guest exceeding the maximum occupancy limit advertised, will incur a charge of 10% of the total cost, per guest (including infants and children), per day and will be charged to the credit card provided. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions may be made on an individual basis - please contact Stay Sedona for prior approval, additional fees may apply. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges will be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the home can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.
Adherence to occupancy limits, as listed on the website is strictly enforced, this includes pet limits. These policies are in place for your safety, as well as the protection of the vacation home and the vacation rental industry.
All pets must be declared, pre-approved and prepaid, please call us for approval and to provide payment. The pet fee is non-refundable and varies by property size. Pets are to stay off of the furniture. (Need old sheets or blankets? Please ask) Any additional cleaning inside or outside is billed at $50 per hour, with a one hour minimum.
Violation of the pet policy will require immediate departure from the rented property, a refund will not be provided. By checking into any of our properties with a pet you agree to accept full liability for the pet and its behavior.
Not all properties allow pets, and they must be pre-approved.
LINENS & TOWELS
Towels, sheets, pillows and blankets are not meant for outside use. Additional towels and linens are available for a fee. Old/Stained towels and linens may be available if needed. Please ask, we would rather provide you with old/stained towels and linens if you need them than have to charge for damaged or stained towels/linens.
Smoking is not permitted in or on any Stay Sedona and affiliates properties. No smoking/vaping/marijuana or drugs allowed anywhere on the property. No exceptions! If there is any tobacco, vape, drugs or any other offensive smell or residue in the home after your departure, you will be charged an additional cleaning fee. Guest is responsible for all damage caused by smoking, including but not limited to, stains, burns, odor and removal of debris. If these policies are violated, there will be a charge for excessive cleaning at the rate of $50 per hour. Guest in breach of this agreement may be required to immediately leave the premises.
Do not put any feminine products or wipes in the toilet. Plungers are provided if a clog occurs. Do not pour grease down the drain. Plumbing issues which arise out of these circumstances will be charged to the card on file.
RIGHT OF ENTRY
Guest(s) agree that Stay Sedona and affiliates reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make needed repairs, alterations or improvements as we may deem appropriate.
SECURITY & SAFETY RISKS
Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Stay Sedona Vacations and affiliates does not assume any responsibility for injuries resulting from your failure to use due caution or negligent acts. Children and pre-approved pets must be supervised at all times.
CONDITIONS OF PREMISES
Guest shall, upon arrival, examine the premises, all furniture, furnishings, appliances, fixtures and landscaping, if any, and shall immediately report, in writing, if any are not in operating condition or are in disrepair. Reporting repairs does not give guest the right to cancel this agreement or receive a refund of any payments made.
LOST OR LEFT ITEMS
Management assumes no responsibility for lost, stolen or abandoned items. There will be a $25 handling charge, plus shipping cost for any found items returned at guest request. Management shall not be held liable for condition of said items. Any items not claimed for longer than 5 days, may be donated or sold.
You may ship directly to the vacation home in which you have rented by using FedEx or UPS during the dates of your reservation. We cannot guarantee delivery or security of the package. This will be up to the shipping client and the shipping receiver to arrange. We are NOT responsible for any lost, damage or delayed deliveries. Guest may NOT use USPS to have mail delivered to the property. Stay Sedona Vacations does NOT have access to mailboxes and the homeowner does not give permission for mail to be sent to the home.
No refund shall be given for number of devices, outages, content, or lack of content or personal preferences with regard to tv/cable/internet/satellite service. If services are provided, they are provided as a convenience only. No refund shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use or personal preferences with regard to service. Please refer to the listing for the property you rented to see what is offered as a convenience. Many properties only offer the ability to use your own streaming services.
If rentals are equipped with air conditioning and if not otherwise regulated, guest agrees the AC shall not be set below 70 degrees and heat shall not be set above 76 degrees. Doors and windows shall be closed when either heat or AC is in operation. If your unit has a swamp cooler, please open a window or two slightly to help the air circulate. There are no refunds for malfunctioning HVAC or swamp cooler units.
POOL AND SPA
If so equipped, spa heating is included. Pool use and heating may require an additional fee. Please ask. Guest agrees not to tamper with pool or spa heat controls, spa heat not to exceed 101 degrees and pool heat not to exceed 86 degrees. Guest understands the area surrounding the spa or pool may not be fenced or secured and guest is liable for any damages that occurs to the pool or spa through guest misuse and/or negligence. Guest is responsible for the safety of other guest using the pool or spa. Rental Fees may apply.
In the event the rental unit sustains a system failure, including but not limited to water, sewer/septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilation, pool, hot tub (spa), or any other system or structural system, neither the property owner not the management shall be liable to guest for damages and no refunds will be given for such failures. However, management will make an effort to promptly repair or replace the failed system or equipment and, in such event, guest agrees to permit manager, or its service provided to have reasonable access to the property to inspect and make such repairs.
UNFORESEEN CIRCUMSTANCES/WEATHER/MOTHER NATURE
Management will not assume liability for any loss, damage or inconvenience caused by but not limited to the following: weather conditions, natural disasters, pest, construction, acts of God, or other reasons beyond its control. There shall be no refunds available as such instances are beyond the control of management.
Management and management representatives and agents have the right to enter the premises at any time, for the purposed of making necessary repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed services. Upon reasonable notice of 24 hours, management may show the premises to prospective purchasers, tenants, mortgagees, appraisers or contractors.
Many homes are in HOA's and the City of Sedona display's No parking signs in certain neighborhoods and do not allow parking on the street. Please park in the designated area to prevent being towed. If you are towed it is your responsibility to resolve and pay for the towing and/or fines.
PERSONAL PROPERTY AND INJURY
Guest personal property, including vehicles are not insure by the owner, HOA, property manager, against loss or damage due to fire, theft, vandalism, animals, rain, water, criminal or negligent acts of others. Owner/Management does not insure against personal injury to guest. Guest agrees to indemnify and hold harmless all owners and management from all claims, disputes, litigation, judgements, cost and attorney fees resulting from loss, damage, injury or death to guest and their personal property. Guest agrees to mediate any dispute or claim arising out of this agreement, or any resulting transaction, before resorting to arbitration or court action. All mediation and legal fees, for all parties involved, will be the responsibility of the guest.

Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Please make sure you are comfortable with our Terms as they are strictly enforced, and you will be required to vacate the property
INDEMNIFICATION & HOLD HARMLESS
While Stay Sedona and affiliates, its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Stay Sedona and affiliates, its property owners shall not be held liable or otherwise responsible in any way for injury or death to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Stay Sedona and affiliates, its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Stay Sedona and affiliates, its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property. Any and all legal fees are the sole responsibility of the guest.
RELEASE: In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my children's or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
Please make sure you have read your rental agreement. Rental agreement and its terms are considered signed and accepted upon receipt of this document.
No Smoking, vaping or drug use
No smoking is allowed on the premises. If smoking does occur on the premises, Guest will be evicted and is financially responsible for all damage caused by the smoking including, but not limited to, stains, burns and the cost of odor remediation and removal and replacement of damaged property.
Due to neighborhood restrictions, parties are not allowed in this home. Disregarding this rule will result in immediate eviction and the loss of any monies paid and any fines incurred will be the responsibility of the guest.
Quiet hours are from 10PM to 8AM and is strictly enforced by City of Sedona Law enforcement
Please leave the home, condo or casita you rented tidy.
Upon departure please make sure all trash is removed and all dishes are clean.
Return furniture and other objects to their original places, including remotes.
Inform us of any issues you may have as soon as possible so we can help.
As a courtesy to your neighbors, please minimize loud conversation, music, and general noise, especially after 8:00 pm.
